Terms and conditions
Payment Terms
- Payment is due within 7 days of invoice.
- Payment must be made via bank transfer to the nominated account provided by RISE HIRE.
Excavator hire day rate = 8hr of work on machine , if more than 8hr is accumulated a second day rate will be applied,
Excavator will be charged at the daily rate for everyday the machine is in the hirers possession - unless other wise negotiated
Safety Obligations
- Hirer must ensure operators are trained and licensed.
- Compliance with Work Health and Safety Act 2011 (NSW) is mandatory.
-Equipment must only be used in accordance with manufacturer, including Safe work load ratings and gross vehicle mass
- Equipment must only be used as intended and on suitable terrain.
. Damage Waiver
- No damage waiver is included.
- The Hirer is liable for all damage to the equipment during the hire period.
-in the case equipment is damaged the Hirer is responsible for payment of all necessary repairs
. Return Requirements
Machine must be returned will fuel tank full unless otherwise specified
-The Hirer is required to return equipment to collection point unless otherwise arranged
Equipment to be returned in clean condition ,if equipment returned dirty/ muddy a cleaning fee will be applied
- If the delivery and collection of equipment is arranged RISE high will collect equipment upon agreed date/time
-if equipment is unavailable for collection on agreed time or collection is delayed additional charged may apply
-equiptment must be in suitable condition to transport eg. Excavator tracks clean and free of mud and debris
1. A KM rate to return from point of collection will apply if return conditions are not fulfilled
2. Additional day rate hire will apply until equipment can be collected
. Liability Limitations
- Provider is not liable for delays, indirect loss, or injury caused by use or failure of equipment.
- Hirer assumes all risk and responsibility once equipment is in their possession.
Insurance
- Hirer must have public liability insurance covering the hire period.
- Proof of insurance may be requested.
- Provider maintains equipment insurance but does not cover third-party or on-site risks.
. Repossession
- Provider may repossess the equipment if:
a) Payment is not made on time;
b) Equipment is misused; or
c) Hirer breaches agreement terms.
- Entry to premises may be made to retrieve the equipment.
. Default and Remedies
- In the event of default, Provider may:
a) Charge late fees;
b) Recover costs including legal fees;
c) Terminate the hire.
- Hirer remains liable for all costs incurred until recovery.
Governing Law and Jurisdiction
- This Agreement is governed by the laws of New South Wales, Australia.
- Any disputes shall be resolved in the courts of NSW.
. Dispute Resolution
- Parties agree to resolve disputes via mediation in good faith before litigation.
- If unresolved, either party may pursue legal remedies.
Customer Obligations
- Maintain equipment in good order.
- Report any damage, fault, or loss immediately.
- Do not sublet or relocate equipment without written permission.
- Ensure equipment is used safely and only for intended purposes.
. Ownership
- The equipment remains the sole property of the Provider at all times.
. Acceptance
By signing below, the Hirer agrees to the terms and conditions set out in this Agreement.
